Advice please? Would you let a horse go without payment?

No never. As long as a sales receipt is made and signed between two people then this can stand in court if your sister didn't deliver the horse, not saying she wouldn't.
My dad brought us a very expensive static home to put on his land for us and they wanted full payment (a private couple, not a company) before delivery. He went mad with worry but he called his solicitor who confirmed that its normal for payment to be made first and a sales receipt signed by both parties is legally binding.
Get them to deliver in the week instead and get payment first :)
 
They have agreed to collect the horse with the rest of the money next weekend! My sister is not happy as she has given her stable up and was told the pony was going tomorrow, transporter also let down, and my sister now has to wait another week ;-(

I think your sister needs to thank her lucky stars that is all she has to worry about right now ;) I sell youngsters unseen to another country, often hundreds or thousands of miles away. None of my horses get on that shipment south until the money is in my bank account.
 
Hi guys, my sister is selling her daughters pony, it is sight unseen, people have had pony vetted, transporter due tomorrow. They have only paid a third (900) 1800 is remaining. They are saying they want the pony delivered and then they will pay the remaining 1800 on arrival but it may take a few days to show in the account due to it being the wkend. My sister has explained that she feels uncomfortable letting the horse go 250 miles (5 hours) to someone she has never met. The buyers are saying they feel uncomfortable paying the whole amount to someone they have never met, but this is their decision saying it is too far to travel. My sister have offered they come and collect the pony themselves but they are refusing. The transporter is due at 11am. SO would you let the pony go and trust them or politely refuse? She is not experienced with selling horses so any advice welcome. Thanks in advance ;-)

No chance no way they cannot dictate the rules.

Say you want payment before the pony is collected. If they wont do this say the deal is off you wont sell the pony and they lose their deposit.



Make sure its cash only, and not a rubbery cheque.

When they say "with the rest of the money" do they mean cash? No way would a cheque be okay. It's a lot of cash to be carrying.

I bought Mollie from a long distance away, via a friend. I paid the money online into the seller's account before Mollie set off on her journey to me.
 
As somebody who has bought sight unseen due to the distance, (although I did get a friend to go and view the horse), I booked the transporter early due to the fact that it was a 300 mile run, then paid half as a deposit, then did bank transfer for the rest. The transfer can be done and shown in the other person's account by the next day, so tell your sister to go for that option. NEVER a cheque!
 
I've always paid cash, and been paid cash for horses, however much it was.

I'm not saying paying cash is a bad thing, I'm just meaning the OP should make sure they don't turn up with a cheque! If they did, it would probably be too late to get hold of such a large sum of money as cash.

Fully paid up, in CASH before the horse leaves, or I can easily see this getting sticky. A friend of mine sold her horse in installments years back, never did get the whole amount paid and that was to someone we knew and who lived close by!
 
The rule in selling livestock: Ownership passes with the cash. That's cash in hand or in the bank, not a cheque.

Horses are not cars. Things can go wrong. The damage to a working animal can be mental as well as physical.

The owners of my current car were ultra cautious and we only concluded the deal by both of us going to the bank and doing a bank transfer.

One of their worries, they said, was that if paid in cash, the notes might be counterfeit! That's one I have never heard of before but perhaps worth bearing in mind! Apparently, it is how crooks launder money. Learn something new every day.
 
Absolutely, bank transfer before collection. ..or whilst there via phone/internet banking. Your sister then moves money to another account (saves risk of recall..though that shouldn't happen). Only then can they take the horse. Tell them that now, they may pull out but rather that than lose money. Otherwise it may go pear shaped on the day.
 
I've always bought mine with a bank-guaranteed cheque, easy to arrange and collect from your bank and secure for the seller.
Haven't bought for a few years though, maybe that service is no longer available?
 
Nope don't do it. Sellers delivered my boy and I paid them in cash before he came off the wagon - they counted it on the yard floor and signed a receipt. There is another thread on here from someone (miss l toe I think) struggling where half money hasn't been paid and there's now an ownership dispute - that's a stark warning

Well, at least your sister has a large deposit now so at least she knows they will still go ahead with the sale. Tiresome about the stable and transporter, but better that she gets the cash up front. Let us know that it all goes well next weekend?
 
Just because they have paid a deposit doesn't mean they are less likely to mess around. If it was me the pony wouldn't be leaving the yard until the money was in my bank in full and the new owners had been to see the pony so that I could check that the pony was going to the right people. I wouldn't trust them, it sounds a bit too dodgy for my liking!
 
Never! And being an honest person, I wouldn't have a horse delivered without paying the full amount either- I'd be up to something If that was the case.

I bought a pony unseen from Ireland, didn't even have it vetted and hadn't paid transport. I told the chap the money was on its way over, but he had no proof. I said i'd get a receipt but he said he'd send the horse based on trust the money would come through.

I refused to let him send the pony until the money had arrived as I felt bad and like it wasn't fair on him, he thanked me for that and was much happier when sending the pony with the money in his account :). I really would be suspicious of anyone being sketchy around money...
