bad livery

*update* received a text yesterday telling me the horse will be moved today! I politely text back and said of course thats fine, let me know a time so we can give you access to collect the horse and your belongings. that was at 1pm yesterday afternoon, so far ive received no responses to my texts at all. She did tell a friend of mine she has got another yard to go to but as the day is going on, Im not quite sure what she is playing at

Do you have transport or could borrow from someone? Could you move the horse to the new yard just to get this nightmare off of your plate?

You have my sympathies, somehow favours for friends often turn sour!

My trailer is out of action, (floor has gone) typical!! I may be able to borrow transport, but the issue I have is that she wont tell either me or my friend wheres shes going! I would even pay for transport just to be rid of her lol. but I think shes worried I may tell the new owners (if shes telling the truth of course), what shes like. this was only supposed to be for 6 weeks anyway and im now on week 4,the nightmare has gone fast lol.

I should also add that the last text I got that stated she was moving today said and I quote: I dont have to tell you why I havent paid you, my solicitor said I dont have to inform you of that. oh for real! yeah like I believe that lmao. I should have also stated that within 2 days of her being with me I had to ban her from bringing her 3 year old toddler with her. so she started to avoid me. my insurance does not cover it. yards are dangerous places!! she didnt keep an eye on him, let him round around screaming, I saw her on CCTV leave him outside the main gate!! and also saw on CCTV that she let the 3 year old take the horse for a walk, left them to it walked back onto the yard with her mate and carried on mucking out!!! I was mortified. so she said well ill leave him in the car then! the kid lets himself out and I almost ran him over two weeks ago. its a nightmare. ive asked her again, when are you leaving today?? and im getting no response at all :( I should have also said in my initial post the main reason for me locking her out of my yard since thursday, is not only due to her not paying me, but is also due to now having the local council breathing down my neck.

thanks and for the small amount that it is at the moment, I would just to get rid of her! My friend has managed to get hold of her now and she said ive told her a time already, why is she calling you?

thats a blatant lie lol, ive not had one message back yet!

Oh goodness. This sounds just like a farrier that owes me money. He was even bold enough to say he transfered it to my friends account (without having her info!). I've no idea how to handle these people. He's blown deadlines set by the solicitor so I am taking him to court.

Excuse after excuse. Just poor behavior. I don't get these people. It is as though they feel everything should be given to them. If you can have it, they can too, for free!

I do hope you are rid of her soon!

...and that the horse is rid of her too ?

me too! i sent her a text saying dont put the phone down on me thats just stupid. give me a time you are arriving and you can have the horse. so she put back hes mine! what do you mean have he is already mine!!! to which i replied all i meant was, give me a time hes being picked up so I can be there to let you in, dont panic! you know I dont live on site. jeeez some people!!!

As a YO myself I can only say what a horrible situation to be in.

All I can suggest is that the OP seek legal advice concerning this matter. If the OP is a Gold Member then the BHS legal helpline is an obvious place to go; however at the end of the day you may find that they steer you towards finding your own Legal Advisor and talking to them direct - which is what I would advise you to do.

I think it may have been a slightly unwise move, if you will permit me to say it, to prohibit the livery from the yard; that has given her fuel-to-the-fire to badmouth you. Better perhaps to give her a specific time of day - when either you or your staff will be at the yard - to come and do her horse. That way, you could not be seen to be "prohibiting her access" to her horse. Legally, I think you may be on sticky ground by not allowing her access..... however I am not a legal person so I couldn't be sure on this point.

Whatever, I really do think you need to talk to someone "legal" about this. Perhaps the livery would consider "gifting" the horse over to you in lieu of her outstanding livery bill; but even if that were the case, you would be well advised to have all of that arrangement sewn up legally.

Awful situation. The poor horse is the loser in all of this. FFS some people.

Yeaaa, that's what I thought about banning the livery. It a crapshoot really. Ban the livery (which could have consequences) or let her destroy the place and act nasty while she is there.

Kills me when people don't have contracts in place, but I get that they are coming from a good place and are genuinely trying to help out the horse and owner.

But then, for people like this, why have the horse?

update for you guys! shes gone! oh my god I am so relieved I cannot tell you all! thank you all for the advice etc. I really appreciate it. after her giving it the billy big one via text lol which didnt bother me one bit, I just replied get off my land by 5pm please.........a trailer turned up at 4pm and I have never seen anyone move so fast in my life! she did not face me herself, sent her dad and her friend to do it whilst she hid in the trailer. her father actually shook my hand and thanked me for everything, to which I replied thats fine, she never paid me even though she told you and everyone else she did! But I just want rid of her now! make sure she pays at the next place mate! I gave the horse a kiss goodbye and handed him over. job dobe. at least he had 4 days of being treated properly and had a nice deep bed etc. I just hope and pray she looks after him now
