Do I need to give livery notice if my horse was PTS

Apologies if I sound defensive, I just could not see why I would need to pay 1 extra payment beyond my needs, given no contract was formed.

Secondly, I wouldn't be paying a penny. A months notice for what exactly?!! Awful, horrible behaviour.

I'm interested in what Mithras says however I have questions. What would happen with a car that was totalled? Say you have the car on payments and you only have one more payment to make. If the car is damaged beyond repair, does that mean that the contract is void because the subject matter has been destroyed?

That's covered by s7 SOGA79 and not the Law Reform (Frustrated Contracts) Act 1943.

I'm not answering any more questions! I actually work as a law lecturer although I am still a solicitor, but I'm on my summer break. I must admit I do find some material from these forums occasionally to turn into fictional problem type questions for the students.

So in the example where a horse is pts on the 2nd of the month and livery has been paid up to the end of the month, should the YO reimburse?

Would the same apply with people so if I died and I've paid my mobile rental for the coming month, should O2 reimburse my estate?
Can't help with O2 but any council tax, phone line rental, water rates, gas and electricity paid in advance would all be refunded from date of death. And in the case of my Mum, her care home refunded the money from date of death (we paid a month in advance, monthly)

Guess that clears it up then.

I have known people in the past be told to leave with no notice, maybe that's why the this YO doesn't do written contracts? I can't imagine any other reason why they wouldn't. Have also had people do overnight flits from yards and they have never been followed up for payment of notice to my knowledge. I guess it's because it would be difficult for either party to make a claim.
 
Hi, Devastatingly my horse died in an unexpected emergency. The yard owner has requested a months notice despite me not having any contract. Can anybody please advise what I should do? I do not feel that I should pay for an unexpected event (particularly as there are still plenty of vacant stables). Or is the yard owner correct? Any suggestions appreciated :)

disgusting. As a yard owner we had a livery PTS in Sept. I would NEVER ever even think about charging after the day especially if it was unforeseen.

YO should be ashamed of themselves totally.

OP,I'm so sorry for your loss.

I confess I had assumed notice would be payable, because I assumed the contract was for the hire of facilities, not anything relating to that specific horse - more like hiring a garage then crashing the car - so I'm very interested to read otherwise.
 
There was no contract.
The OP paid for one month in advance and has paid what she owed.
I don't think she needs owes any money to this heartless YO!!

I think as youve stated, this is different, which is why people arent pushing for her to pay, its not taking the horse away for better services and facilities elsewhere and leaving the yo with an empty stable because of it, most people feel its wrong simply because of the circumstances and its the decent thing to do. when someone has had to spend money to pts and dispose of their beloved animal, to hit them with charges for care and facilities that cant be given or used is imo just wrong
