Family sue Somerfield after boy dies

Whilst i am *deeply* sorry for there loss, i cannot begin to imagine how they must be feeling, this tragic accident is *not* Somerfields fault.

My boys know full well that they don't swing on the railings, and they will get told off if they do.

I saw this item on the TV news last night, and I absolutely agree with you. Why do parents not take responsibility for the behaviour of their small children? How can the shop be responsible for their negligence?
 
Yes, agree, it's down to parents to supervise and sadly accidents do just happen sometimes, regardless of whether parents are watching or not.

Unless there was something wrong with the railing which hasn't been reported yet, I don't see how it is the supermarket's fault.
 
How on earth can this be Somerfields fault?!?! It is up to the parents to not allow the child to swing on the railings.

Another example of the blame culture we live in.
 
This is a really sad story but agree with the above, we live in such a blame and sueing culture these days its terrible. The boy wasn't in their care so why should they be sued?
 
A supermarket isn't a playground, it's somewhere you go shopping. If you can't control your children in the supermarket, don't bring them, go shopping when someone else can have them.
 
Society seems to have gone totally mad. Everything is always someone else's fault (I don't think!!!!)
Whilst I feel so sorry for the family it is their responsibility to watch their child.
I often see children standing on and in supermarket trolleys. if they fall out who is responsible? the parent/carer or the supermarket? IMO it is the parent/carer This is a similar scenario.

many, many years ago I swung from a bar and fell off when at school and was unconcious for a while. Should my parents have sued the school? NO. I was the one who "chose" to do something I shouldn't have done.

yes, definitely... the floor was obviously made of the wrong material if your son could possibly fall over. you might get a million pounds out of it, you never know!

i find this increasingly litigious culture unbelievable. a few years ago i was at a garden centre and when i picked up a bag of compost to put on my trolley, the next 3 slid into my leg and knocked me over. no probs, i was fine, it didn't hurt at all, i just said 'oops' and laughed about it. a nearby member of the public who had seen came over and said, i kid you not "do you want me to get the manager? i witnessed that! you could sue them!" when i said i was fine, she tried to hush me, and persisted. absolutely unbelievable.

i hope the judge laughs these people out of court, and that this case bankrupts them, as a lesson to all.
 
I bet it is one of those cases where the lawyer has taken it on as a no win, no fee - but presmuably thinks there is a big enough case of Somerfield settling out of court or something as being less hassle. Hope they wont as just encourages people to sue for no reason like here.
 
I am sorry for the familys loss, but I am also sick of the blame culture and total lack of disapline, kids are allowed run riot in shops and public by parents who because of their failings then try to sue instead of accepting personal responsiblity when their little "angels" get hurt.. Todlers screeming runing amock then when they get older stealing and vandelism .....you can see the pattern forming ...

I see this a lot at work. Now if the railing were not there and a child ran out in front of a car the parents would probably sue too! Terrible tradgedy but hopefully the courts will find in the supermarkets favour.
 
when i was little i feel over an uneven paving stone at a supermarket. I knowed out my front teeth and now at the age of 24, my front teeth are false. and to add insult to injury my mum told me off for not paying attention!!!!! good old mum x


The world has gone mad. i took the team horses away a while ago and one horse failed the vetting. the owner said nothing until the last day when she announced she didn't want her horse traveliing at the back of the lorry as he aparently feel off the back whilst unloading at the event and thats why hes lame!!!!!
luckily for me the other team members all unloaded their horses at the event and stepped in and told her he didn't and put an end too it. Lesson learn't for me, unfortunatly not travel others horses.
 
IMHO it is the fault of the judges who don't throw out spurious claims and stupidly award huge claims.

It is the parents fault.

People are incapable of looking after themselves now - what happened when your ancester walked along a foreast path and tripped, who did he sue. Use your eyes and look where you are going - that is what they are there for.

That is exactly why, once a month, the in laws have my boys for the day and we do a massive shop on our own. There's NOTHING more irritating in the world than kids running around loose in the supermarket.

I was *so* embarrassed when my little one fell in Lidl.
 
And can you imagine what the reaction would be if you if a member of the public told off a child for behaving dangerously and annoying other people in public - you'd probably be had up on a child abuse charge...so you are supposed to just look the other way and try to ignore badly behaved chidren - who their parents probably would say are just learning to express themselves, little darlings.

Having said that, doesn't mean at all that I don't think that it is terribly sad that this small child died in a total accident - but unfortunately accidents do happen every day. I assume this one is actually only newsworthy due to the attempt to sue Somerfield.
 
What is this world coming to?? Too much cotton wool and if something going/gone wrong it HAS to be somebody elses fault! I think everybody should take a look of the meaning ACCIDENT - it happens and you can't do much about it after. But hey, us horsey people know that all too well??!!?

Totally agree - your child = your responsibility!
The lawyer who has taken this on is renowned for accepting high-profile cases; he's an old campaigner....Mmmmmm, we shall see?!

I think you'll find that very VERY few of these cases actually reach a judge. If you want someone to direct your ire at blame the insurance companies who settle rather than risk the costs of fighting it all the way to court (often against the wishes of the insured)
 
Absolutley ridicukous IMO

Although wonder if something was wrong with the railing due to comment at the end about it should not have been in that state.

However, if child wasn't swinging on it should not be an issue. Whilst I wouldn't go quite so far as to say children should be seen and not heard I would say that they should be under control ie parental supervision and be brought up with the sense to know that consequences can occur.
 
What, if anything, was wrong with the railings? Why was the mother not supervising her own child? has anybody come across the word 'accident' Society has gone stark raving made. This will up the cost of goods for everyone in Somerfield.
