Jack's Mum, in answer to your question about does the pony the instructor describes sound perfect, no it doesn't.
But it does actually sound very nice, if a little nervy. There are plenty of horses (including my first share) who do way worse things than that and are fine for first-timers (if they can already ride a little).
I'm pleased to see you are taking responsibility for the first pony you bought (as well as enjoying the second). Please bear in mind if you are going to rehome the first that actually it sounds like a perfectly good little animal (subject to vetting) for a semi-competent little rider.
Your little man may be more suited to something calmer just for now but this little pony could make another child very happy.
By all means complain if pony was mis-sold but please keep in mind that it isn't pony's fault and that, if you come to rehome pony, it isn't a 'problem' animal, just not suitable for nervous novices.
