I don't think you can really tell from what is in the article, though the fact the driver just carried on doesn't look good.

Where I live there are often loose dogs (and cats, and kids) in the road. Not to mention fairly regularly sheep, cows and ponies, either being moved or escaped. Just yesterday there was a dog having a snooze in the middle of the road on my way home. So if a driver was roaring along they could probably cause a slaughter. They are quiet country roads that cars have to share with other users and people should drive accordingly, not act like they are on a dual carriageway.

On the other hand if a dog leaps out of a hedge right in front of a moving car there's not much the driver can do.

In the car I was in the dog ran into the side of the car .
There’s no different in this sad case between a deer and a dog I have hit a deer I was proceeding down a dual carriage way at sixty when the deer came over a hedge right in front of me no way to see it or stop.
You cannot always prevent accidents with loose animals .

That is somewhat different to the story in OP, when the driver ran *over* the dog

The deer I hit was in front of me I was travelling under the speed limit at night no other traffic I could prevent on accident .
I have to say I saw a Sainsbury’s van come down the main drive at a ridiculous speed today I almost went down to catch him on the way out and give him a bit of training but I was a bit involved with servicing the pop out .
regretted it though .
