Dont leave it a week. Tell them what is going on and provide documentation showing you would have been insured if company had not cancelled it.

You will have the cover note and certificate of insurance which was issued when he first took it out. If you keep them informed you could be given longer to sort it out, better than a summons next week.
 
Sorry to hear this - have read a few of your previous posts (otherwise it's too easy to be judgemental) and see you have had a bad year including your OH having an extremely serious accident that you witnessed.

If selling is your only recourse do your best to find him a good home and maybe it will give you more financial freedom to sort out your life for the better in the long run?

Interesting point about the certificate. As far as I know, the insurance company have to request that back from you if they cancel. Can they prove they did so?

Thanks sussexbythesea. I think its been a long time coming, but its taken this to just tip the balance i think. I'll be sad to see him go and i've been clinging onto the hope i might be able to keep two but i just dont think i can :(
 
If its the insurance companys mistake then are they not liable for the effects of their mistake? Can your boyfriend get a loan to pay for part livery or taxis due to not having use of a car or to pay the extra car insurance, then claim the cost of that loan off the insurance company?

As for the points and fine, a friend of mine couldn't cope with any more points so let a road conviction go to court and was banned for 2wks instead. No points, no fine, just the ban.

The police were completely useless after I was stopped and I assumed it wouldn't go to court but it did. They just won't listen to any excuses, kept saying everyone has an excuse and adamant that we would just be found guilty. The court was totally different, listened to what we had to say and threw it out. Don't listen to what the police say ....

Yep, i read it as he only had 3 not 6...but some seemed to assume he had 6??

Hastings are shocking, they dont communicate with you, we accidently bounced our payment, called them straight up once we realised, so we could make a payment & they declined it & said they would reapply to the bank in X amount of days, so we left it like that, thankfully i kept tabs on our account & noticed the payment still hadnt left our account, called them back to ask why it hadnt left our account & they said if the payment was received there & then they were cancelling our insurance. Admittedly initially it was our fault the payment was missed, but to then decline payment & to the fail to take it from our account as promised & to not even send a letter to say they were going to cancel it if the money was received by X day, is really quite bad, they had our number & didnt even try to call, which would have been something.
Good luck sorting it & give them hell :)

The manager on the phone initially said they'd tried to phone him, but then changed her mind and said she hadn't.
She then decided that she'd emailed him on the correct address, though no email had come through to his inbox or his junk emails. They hadn't tried to post him anything.

Also, horsesatemymoney, OH is out of work currently due to a bad motorbike accident he had in July. A loan just isnt an option and i wouldnt expect him to pay for MY horses anyway.

Because the only way they would know he had no insurance is if they ran the registration number through their computers.

Why would they do that for no reason. It might have been something as simple as erratic driving or a light out, but there would have been something.
 
Sorry to hear about your situation what a pain.

Tell the insurance company you want a copy of the email that they sent to your OH as if they did send anything it will have date etc on it, as they should still have the email on file or soemthing.

His car does look suspicious, its a bit of a shed to be fair!! He often gets pulled just for how it looks. But it recently passed a full mot so they can never say anything usually.
We were also lost so must have looked odd as we kept driving down streets and turning around looking for the right one. So they perhaps thought there was something wrong.

They have something in the police cars that scan all the number plates they pass & they will flash up on the system if they arent legal in anyway. You dont have to be doing anything illegal to attract the attention of the police.

I would have thought they need to write to you in the post anyway. Definitely worth following this point up.
 
Surely if he has proof of payment, they have no reason to have cancelled the insurance so would easily win in court. Phoning or emailing is not good enough if they want to cancel a policy they have to put it in writing that means good old snail mail.

This is my argument and this will be our next port of call on monday as OH is at a funeral in Kent this weekend and this company dont answer calls on weekends.
 
My partner was pulled over for having no insurance. He had taken out temp insurance, and taxed it a few days previously. The cops rang his insurance company, as their system said he had none, and good old direct line said he wasn't insured! Cops were having a field day, until partner got involved and spoke to woman, who then agreed he was insured. Anyone who says these companies never make mistakes has never had to deal with there incompetance. Don't give up on this, if you can prove it has been paid for fight it all the way, but be prepared to fight, and write lots of letters.

First thing to do is get out all the documentation they sent him when he took out the policy.

Read every bit of it, especially the small print, carefully.

Somewhere in there it will tell you the circumstances in which they will cancel the policy and how they will let you know.

Insurance companies dont usually try to cancel policies unless they find out you have not declared everything when you took out the policy, dont pay instalments, or do something else which makes you a bigger risk.

I'm not sure if they have the right to cancel, without proving he had been informed, if they think he had lied about something, but its possible.
 
This happened to me 3 years ago. Policy had been cancelled, they said letter sent by recorded delivery, but had no signature. Monthly payments were still going out of my account. Got stopped on M1 and told I had no insurance, despite still having the certificate at home. Car towed there and then. I already had 6 points. Went to court and got 6 points and £500 fine. This put me on 12 points. Begged for my licence and was allowed to keep it. 2 days later I lost 3 points as had been on there 3 years. With fine, storage change and tow charge cost me £800 which was almost double my insurance. Said insurance company refunded me £62 which was 2 months worth they had taken after policy was cancelled!! I was not amused!!
