If you dont pay your poll tax you go to prison. If you kill 2 horses, injure and seriously injure the riders, what do you think you get? 9 Months suspended, 200 community service and a 3 yr ban. no compensation to the injured to be paid.

Oh Benson, I am so sorry. The law is indeed an ass at times.
Theft of proerty gets a heftier sentence these days.
You must be devestated!

I'm so sorry to hear that, it really is a ridiculously pitiful sentence for what happened to you, your friend and your horses.

I hope there is some way of appealing or protesting to get a review of the sentence if you want to go down that route?
 
((((((Hugs)))))) If you wanted to pursue the guy further you may be able to take the him to the small claims court to either recover the insurance excess or if you didn't have insurance you may be able to claim for the value of the horses. :(
 
I'm so sorry. I can only imagine how you must be feeling. I hope Karma turns round and bites him on the *rse.

Sooo angry and disappointed for you. It's not fair.

Aww Benson, I feel awful for you, that is not a result I would be pleased with either :(.

Hopefully he relies heavily on his car and the 3 yr ban will be a great annoyance to him.

Can you pursue him for compensation via a civil route?
 
Solicitor has been involved in claiming compensation since the beginning, so will carry on with that, but I dont know if I have the energy to appeal. I just feel empty, and numb.

Benson first let me say that I am really, really sorry that you feel you did not get justice.

But for everyone else who posted, not for you, who must be devastated, some explanation is required because the law is not quite so much an ass as all that.

For you not to be awarded compensation, then either the CPS lawyer did not ask for it, or the man convinced the court that he had no means to pay it. You can claim from a central fund for your injuries.

The penalty for not paying council tax is not imprisonment, it's a fine.

Sentences are intended to deter the same thing from happening again, as well as punish. If the judge felt that there was little chance that he would do the same thing again, then he suspended the sentence "in case" he did, and added a punishment of unpaid work. The suspended sentence can be invoked if he commits ANY other crime, so it hangs over his head as a deterrent the whole time it's in force.

As far as punishement goes, unless it was proved that he drove into your horses deliberately, then he is guilty of no more than dangerous driving and the penalty is much lower than if it was proved that the act was deliberate (which with that penalty, I doubt).

If the man is in this area, he WILL do 33 days of work for the community. If may still not be enough for you, but if he pleaded guilty then it's as much as he could be given. The law dictates a 33% reduction for a guilty plea at the earliest opportunity (which may be very late if the charge is changed at the last moment as it often is).

And let me repeat, Benson I am SO sorry that the end of this case has not allowed you to go home and put it behind you. If you are certain the man has means, and you can prove it, then I suggest you raise a claim against him in the small claims court or find a no win no fee lawyer and sue the pants off him in a civil court.

Omg I am so sorry. Have no words. All that I can think for u to do is hit him where it hurts. His wallet. See a solicitor and bring a civil claim for compensation. Again I am so sorry. And angry
 
Just seen this. :( I am SO sorry I don't know what to say. You must feel physically sick:( I really believed today was the day you could start to put things behind you but I can see this will be even harder now.

It is no help at all now but the older I get the more I find "what goes around comes around" and he WILL pay for this someday I am convinced.

Well with the justice system, if you can call it that, full of dementia ridden octogenarian old boy asssholes dishing out sentences, you weren't actually expecting a result were you, I really don't know what it's going to take to get this countrys head from up it's own arse regarding law and order and "punishment", yes "punishment" ooh baaaad word, heaven forbid the criminal should get "punished", I expect some fluffy will report me for using the "punish" word, yea well jehova jehova jehova jehova........

Very annoyed and very sorry for your lack of closure on this sad case Benson.
 
Echo all above, disgusting and sickening. So sorry Benson, you must be feeling so deflated and pissed off, our words can't make it better but so, so sorry, no closure yet, just bitter anger, but if you can pursue him through small claims when you have the inclination you really should. Hugs and a large glass of wine or two tonight for you poor, poor people x

This makes one sick, obviously, if the injuries had been the other way round the court would probably taken a totally different view, and maybe some sort of justice. I hope you can take a civil action and take him to the cleaners, but I suspect it will not happen.
Does that person not have to make any monetary payment, it is sickening, no other word for it.
