Feeling a bit more level headed now! The wine is helping!! I guess the best way to look at this is, if he had gone to prison for say 4 months, he would then come out, with the ban, and that would be it. But, he has got to behave for 12 months or he will be imprisoned, he has got to do 200 hrs of free work, got to retake an advance driving test before driving in 3 years, he has got to go on some sort of attitude course, so gonna last a lot longer than 4 months!!!
 
I would think it would affect his ability to get insurance too! At least I would hope it does.

I am so sorry for what you have had to go through. I would be livid at his "cost".
 
Wine or no wine, its still a bad deal for you, I don't know what the answer is, sometimes I understand the "eye for an Eye " justice system, but that does not seem to work either.

and as far as I am concerned 200 hundred hours of "work"... what do they do ...... make it a proper physical punishment, grinding up 200 tonnes of rocks into gravel, they should wear orange overalls with "killer" on the back, and so their neighbours know all about it, wear the overalls 24/7 till the punishment is over.

It must be so hard for you but to add to the above when he does come to drive again his insurance will be so high as to be virtually unaffordable
 
Justice is never seen to have been done when compared with the efects on those who are injured.

When I was 12 I was beaten unconscious by a gang member on a council estate. He was 22. The police seemed to be powerless to do much about it. However he ran into my father on a dark night some time later. My Dad was a stonemason, not an acountant. Unluky for him then.

Just hope he steps out of line then in the next 12 months.

I am very surprised they did not order compensation - that is, after all, why we all have vehicle insurance. To pay for third party losses and compensation if ordered.

Benson I'm so sorry.

I was at the police station a few days ago to get the crime reference number from the incident where a friend and I were almost hit.........turns out the police officer we spoke to on the day took it so seriously that he didn't he even record our visit!
Fuming is not strong enough to describe it!
 
I'm so very sorry. It really does make unbelievable reading when you see a punishment as poor as that meted out. Especially when you consider the immense suffering you have all went through :(

So sorry, that's just terrible. There is no justice in this country, let's just all keep our fingers crossed that karma comes round and bites them in the ass.... And hard!
 
Been thinking of you through the day, so sorry the punishment has not fitted the crime. Wish he could have been sentenced to spend a few hours in a small room with all of your "virtual" H&H friends!
 
I cant believe it:mad:I felt sure the barsteward was going to get a custodial sentence, probabley only about 3 months but a period of jail time for reflection.

No compensation is ridiculous, if he had written off your car he would have had to pay.
 
Am unfamiliar with your tale, so have been looking through your previous posts, hope you dont mind, and just wanted to say, you are an inspiration, I cannot even imagine what you have been through, and you must be so strong.

Life can be so cruel, but all we can do is carry on, im sure you can only get stronger from this, you are amazing :)

I can really feel your disappointment. However I do agree that at least us tax payers are not having to fund a luxury stay in prison. OH had to do some work in a prison, and was aghast to discover that the prisoners were allowed wine with their meals (he asked what the large collection of wine was used for!).

Bruce it may be different in Scottish law, but in English the compensation ordered by the court is dependent upon the means of the defendant and if he has no income then no compensation will be awarded. The compensation from the insurance is a civil matter, which will be settled in due course now that the criminal offence has been dealt with. It may also be the case that compensation was not ordered precisely because a very large amount will end up being paid by his insurers, provided he was insured.

I understand that it's likely he did this deliberately as part of a domestic dispute, although it probably could not be proved. If so, I hope he rots in hell.
 
Also worth remembering that he will have a criminal record now which will follow him everwhere and he will have to declare it for quite a few things which will hopefully be expensive, career limiting and awkward! Not much consolation I know. The law is an ass!

i am glad the wine is helping! After the initial reaction, which I can FULLY understand, THIS is a far better way to look at things. Was the 9 months suspended for 12 months, or longer? if he is of a certain "type" 12 months is actually quite along time to keep his nose clean. He WILL be paying fro this for a very long time. I know that doesn't ease your suffering, but, as you said, it will last a damn sight longer than 4 months. keep going with the civil claim, just bear in mind, if he's got nowt, the court can fine him tens of thousands or more, but you'll still get nowt of nowt.
Out of interest - just what do people think would have been more "just"? How would they have enforced a huge fine? The fine goes to the goverment, not Benson. And if he failed to pay, he'd go to prison, have wine with his dinner, be called "Mr", and then NOT have to pay the fine. Apply to criminal injuries compensation - i think that comes out of govt funding, not from the offender. It might not be much, but it would prob. be more than the offender could afford, and you wouldn't get paid 50p a week. Best wishes.
 
Benson, I'm so sorry about the outcome - it's not what you want, nor what you deserve. More years than I care to remember, a colleague said "there is nothing fair in this life..." and I now believe this - more since I've got older. Life's a b***h isn't it... Let's hope that he gets his just desserts, somehow, somewhere.
 
I can only say how sorry I am that you didn;t get a satisfactory closure for that dreadful day. It seems this country and it's laws are becoming ridiculous and justice seems to favour the criminal rather than the victim.

You have everybody's support and thoughts but as you said, hopefully the man will have his life compromised for quite a while in one way or another.
 
It isn't justice, but what goes round, comes round. Let's hope he reoffends during the period of the suspended sentence.

As far as it goes for you, look on tomorrow as the start of the rest of your life. The court case is over, the sentence, however unsatisfactory, has been dealt,and I doubt you will get that changed. Keep drinking the wine.
 
Sorry you were disappointed with your verdict. My husband was killed by a careless driver who ended up with just 120 hours community service and a years ban, so I feel your frustration.

Try to remember the good times with Benson and not let your lovely memories be forever overshadowed by what happened.
 
Oh Benson, what a tough day you must have had. It is a very paltry sentence considering the deaths and the damage done to you.
You are looking at it the right way though. I hope you can now put it behind you as best you can. You have done brilliantly since it all happened, very strong lady indeed.

Girls3, so sorry for your loss, that must be hard to live with when the offender walked away pretty much scot free. disgusting!
 
A girl I was 'friends' with at uni smashed into a horse & cart, killing the horse, brai ndamaging the dad and seriously injuring the son.

All she got was a £500 fine and short ban. No suspended sentence, no community service, nothing.
