Disgusting. We are waiting for the taxi driver who killed Cindy to be sentenced on 30th Sept. As the rider wasn't too badly injured, I imagine that sentence will be rubbish. After all, Cindy was just an animal and the law seems to turn a blind eye for the sake of an easy conviction.
Or am I just an old sceptic.....?
Our driver was sentenced because of the severity of my injuries because I was the most serious hurt.....not because of the injuries of the other person or the death of 2 horses. Which to me just doesnt make sense! Honeymum, I hope you get a better result than we did!!
I understand where your'e coming from. My horse was killed ( not outright, she died before the vet could put her out of her agony) by a road rage driver last year.
A couple of weeks ago, the driver, who got a good barrister, had the charges lessened and ended up with a £300 fine and 6 points on his licence. I am starting an online petition. I'm sorry that you, too, have not gained proper closure on this tragedy.
The justice system really is a joke. We have been on the recieving end of it too with a harrisment case, it does leave you feeling total empty and like you stand alone, its ment to be in place to protect and help the good people of this world but it just seems that the criminals get let off with everything and we get another, sometimes even worse off than if we hadn't of gone to court.
So sorry to hear about it Benson, the only advice I can give you is to move on and just focus on the fact that he's got to be on best behaviour for the rest of the time. you say his licence has been taken away from him, he will most likely of lost his job too then (if he had one in the first place?).
It's easy to get caught up in wanting a proper punishment for this man but having been there and done that, it just drags out the hurt and pain

Our justice system is split into two: criminal and civil. The criminal system is there to punish the wrongdoer, the civil is there to recompense the victim. The burden of proof is different for both as well, in the criminal court you must prove beyond reasonable doubt, in the civil court it is based upon the balance of probability.
In this case as he was driving a car he should have insurance that will cover all third parties to any "accident" he has, and if he was driving without insurance then shouldn't the uninsured drivers fund payout ?
You should definitely carry on with your claim and get judgement against him, if he ends up with a judgement against him you will have a claim on him if his circumstances change.
