Loaning and vets bill. Who is liable.

I did read the thread, has the insurance actually refused to pay out though? I'm not sure thats what the OP said. And it does matter if the OP is taking the horse back, of course it does!
 
Why do you say it makes a difference if the horse is returning to the OP frankiecob? The injury still occurred whilst with the loaner and they still signed a contract agreeing to pay for vets fees incurred whilst they had the horse. We also do not know the OP is taking him back the OP says only that he is coming back they do not say why or at whose request.
 
She said the insurance is void for the period he was on loan because the insurers were unaware of this. If it is void they will not pay.

I feel the OP is getting a very hard time on this thread from some people many of whom seem not to have read it properly. She has kept up insurance for herself because of wanting to have it in place ready for when the horse returned. She has made provision for the horse to be covered for vets fees by the loaner whilst with them but some people think OP is unreasonable. I cannot see why.

You contradict yourself in this post.

The OP has said she does not want to try and claim because it will be void because she did not tell them it was on loan, if she told the loaners it was insured then she has possibly lied to them, the clause in the loan contract stated they should either pay vets fees or insure but they could not insure a horse that was already insured and if they believed it already was then the OP has misled them.

I have read the thread properly and she had not made provision for vets fees to be covered because she failed to inform the insurance co that the horse was away on loan and out of her care, she may have believed it was covered for death or accidents/ vets fees but in reality if it had died or needed serious veterinary treatment while out of her care they may well have not paid up, everyone needs to have a clearer understanding of what is and is not insured especially if loaning.
