To be fair, anybody that buys a horse without a vetting really does not have a leg to stand on.
The age old problem of resorting to litigation is whether the person is worth suing. It will be a pyrrhic victory if you go all the way to court and win, incurring legal costs along the way, and the defendant does not have a penny to their name to satisfy the judgment!
