hi, I have just recieved my pay cheque for this month, minus £103 because I took 1 and a half days holiday more than I should have. I want to oppose this, as:

- the half day was actually spent in A & E - sick day, not holiday

- I was not aware that I didn't have the extra day as holiday entitlement - my boss only told me after that it would be unpaid. had I known beforehand, I wouldn't have taken it

- The 3 days between Christmas and New Year, my boss closed the office and said we had to take those 3 days as obligatory holiday. If the office is closed, we have no choice but to not come to work - so how can that be forced upon me to take as holiday?

LEGAL HELP NEEDED PLEASE!!!!!!!
 
A&E is a sick day Agree.

Ask if you can carry the extra day over to next years allocation.

And there's nothing you can do about Christmas and New Year. It's the same in most companies - mine included.
 
a&e is a sick day, however do you get paid sick days? if not then it wont make any difference to your pay cheque.

As for christmas and new year, its the same for most people.
 
I used to be in forces and my hubby is still in and the Xmas, new year thing is the same for us too I'm afraid.
It rubbish, but there's nothing you can do.
Definitely contest the sick day (make sure you have proof though)
 
depends if your company pay you for sick days if not then you would have to be sick for 4 days before you can get SSP
 
The time at Christmas is legitamate as long as you where told in advance.

Accident and Emergency depends on if it was an illness or the result of an accident. If it was an illness then no problem. If you fell off your horse then this depends on the illness policy of the organisation you work for. If there policy is not to pay for accidents caused as a result of someones hobby etc then they are not obliged to pay you.

Our company closes between Xmas and New Yr but we don't have it taken off our holidays - but thats unusual I know. The company my OH used to work for had a weeks shutdown and it was taken off their leave allowance.
 
Christmas/New Year - sorry that's the same at a lot of places.

Sick leave - if you were in A&E and therefore off sick I assume you or someone called in to say you were off sick? Doing this is part of our contract and if staff don't they get into trouble.
 
OK Firstly you need to check your Contract of Employment carefully. If you dont have one then your employer could get in trouble as you are now supposed to have one. This should outline all the procedures you need to follow in the case of absences from work due to sickness or accident. It should also tell you how much Annual Leave you are entitled to each year, when the year runs from and to etc.

If you are only paid Statutory Sick Pay then you wont get anything for the first 3 days, although you should still have contacted your employer to inform them of your absence. Non-notification in many places is now seen as gross misconduct. Bit harsh but with all the new EU Regs./Human Rights Regs. employers are toughening up.

The days between Christmas and New Year should be written into your Contract as compulsory Annual Leave and therefore it is your responsibility to ensure you have enough holiday to cover this period.

It is also, unfortunately your responsibility to ensure you have enough holiday allowance BEFORE you take it. Your employer, however. could have checked this for you and let you know you were over your yearly allowance. Employers do not HAVE to allow a carry-over of any holiday, whether owed to you or to them, however many do allow this.

Speak to your employer and explain that you didnt realise and ask them if you could be allowed to carry that day (or even the half day you were in A&E as well) to your next years holiday.
