returning a loan horse

Poor you and poor girl to be honest its hard but i would pts rather than loan her or give as companion you never know if they will pass on again, you have given her a good few weeks let her die happy
tbh we have 2 youngsters we own and we agree if we couldn't look after them for any reason we would pts tbh I think it's going to be the best thing for the old one as sad as it is, and believe me it isn't with an easy heart we are doing it but it's not fair on her to go back and be dumped in a field

Personally....... and this is just me, but what I'd do in the circumstances is to get the owner to give you a WRITTEN "deed of gift" of the mare OR have a token exchange of money, such as £1, and a written/dated receipt to this effect recording the fact the monetary exchange has taken place and the mare is now yours. You already have the passport OP; but that won't constitute "ownership" as such, and as the owner appears to be such a bint I'd be wanting to get this in writing before doing anything.

Then I'd ring kennels and let them do what had to be done. I'd appease my natural feelings of having been "had" by counting it as an act of compassion/"donation" for horse welfare.

But realise that OP may not be in a financial position for this option; WHY TF do people do things like this???

Most people on here will support you with pts decision, not easy but the kindest one that puts the horse first,if you are not able to keep as a companion yourselves, and why should you it does involve work and costs.

The owner should be ashamed of themselves, it is an awful to refuse to acknowledge responsibility for an animal, but well done to you for being caring and responsible.

Thank you all for your kind words and comments I think the best and kindest thing to for her is pts, as said if we were unable to look after our youngsters we would have them pts and certainly would never dump them on anyone else, I am not a nasty or vindictive person but I hope karma comes round to the her owner

I am very sorry to hear that you have been put in this position.
Very sadly for this mare her owner appears to be totally irresponsible and has no intention of looking after this mare in her old age.
Clearly you have a conscience and want to do the best for this mare and if you can afford to do so then agree to purchase the mare for £1.00 and ask the owner to give you a dated and signed receipt. It should state 'I agree to sell ..........(name of horse ) a xx.x high mare to ..... (name) of .............(address) for the sum of £1. I agree to co-operate in updating the horses passport. Received the sum of £1.00 .................... signed .............. dated
............(address).
You can then do the kindest thing by the mare knowing that you own her.

OP as others have said please get something in writing to cover your back. Also whilst being such hard decision to pts I support you thoughts on it saving the poor old thing an uncertain future. Just a pity her "owner" could not have cared xx

Definitely agree that you need to get ownership in writing, e.g. a 'receipt' from the owner for 'sale' of horse to you (for 1 pound or whatever) before PTS. You may also find that it is worth telling the owner that you intend to PTS and that is why you need the receipt. You'll either find them very relieved as they couldn't afford to or that they come fetch her asap.

this pony has soundness issues that make it unrideable, the owner should have done the right thing by the pony and pts. Companion homes are few and far between and no garantee the pony wont one day end up with the meat man anyway.

why some people cant seem to do the right thing by their animals i have no idea.

This old arguement. Why do you assume that just because the horse is lame its unhappy? I dont think any horse should be put down just because it is no longer rideable. There are good companion homes out there so dont automatically assume the owner is cruel for not putting the horse down! I'm looking to loan out one of mine who is mechanically lame, I make it totally clear that he is not 100% sound in the advert in the first place and is only suited to hacking (which he is perfectly able to do and loves it). Going by what you're saying, I'm a nasty owner who should put him to sleep! Why? He's a lovely, very happy horse and if I find the right loan home then great, if not, he stays with me.

But this horse can't even go hacking. There are few companion homes and particularly with the awful weather we have been having, there isn't going to be a queue of people willing to give an unsound horse a home.

in an ideal world all horses would live happier ever after but it isnt an ideal world. Yes magicmelon well done for what you will do for yoursbut some people see responsibilty to thier own differently. I am someone who made descision to have my mare pts rather than re homing. why? cause i could not have resested worrying about her. In the current climate of far to many horses for homes more people need to think clearly of thier horses future. not arguing that there are good companion homes out there but i myself took responsibility of my mares future x

This situation is not the same as yours.

It is one thing to retire a horse that has given you many years of fun, and quite another to take on a new horse which promptly proves unsuitable, and to then be expected to give it a long retirement.

I always retire my oldies, as long as they are happy and pasture sound, but I will have already owned them for most of their lives.

Thanks to everyone that replied just an update we eventually agreed to take her as a gifted horse and have found her a lovely new forever home with a lovely lady that has other golden oldies the original owner it would appear just wanted to of load her we have since bought another horse that is more than upto our needs and more importantly other pony adores

Well done for doing the right thing by the horse.
The original owner should be totally ashamed of themselves and never ever be allowed to own another animal.

I agree, but unfortunately there are "serial owners"

I bet she has already got another horse. I've known quite a few people shout the old mantra of "I can't afford to PTS" (I put a few quid away each month as soon as my horse reached its 20s) then promptly go out and spend a few thousand on the new one, along with all the latest fancy rugs, bling and other unnecessary items where we genuinely cash-strapped folk make do and mend, buy second hand or simply go without, or the one who "couldn't afford to have the vet out" to her very lame horse but was still going out on the razzle two nights a week and smoking steadily. This is why I don't have a horse any more, I can't stand to see it.
