Spindles Farm sentencing

[ QUOTE ]
I am SOOO happy!!

It just a shame the prison will have to feed him for the 6 months he is inside.

[/ QUOTE ]

My thoughts exactly! They should starve him and not provide a toilet so he has to stand/sit/sleep in his own excrement for 6 months.

[ QUOTE ]
Apparently they are going to appeal against their sentences!!!! Lets hope they do and get more!

[/ QUOTE ]

Am I right in thinking that in appealing it costs the prosecution more money to attend court, legal fees etc? If the sentance is upheld on appeal does the fine he intially got increase to pay the prosecutions extra costs in the appeal?

Well they have to wait five years before they can start the appeal process so I wouldnt worry too much at this stage.

Youd think that after JGs last appeal against conviction was turned down he would have realised its pretty pointless!

Send him here and I am sure I can find a nice little place for him to sleep (concrete) and maybe (just maybe) I might remember to feed him from time to time......Oh and then there might be other things that I forget, like giving him water and.......I could go on, but I won't.

Sorry, It's not long enough - he will probably be out in around 3 months. Sad, so sad - poor horses and to hell with him.

Pointless yes but worth a try for him, I believe he's on legal aid (how I'm not sure (another reason for me thinking he'll get out of paying the £400,000 fine!!)) so it won't cost him anything to appeal!!

I thought it was just the ban he couldn't appeal against for 5 years, but the sentance he can appeal against now? Is that wrong?

ok, in respect of appeal against sentence - this is an open which is open to the defendants. The DJ only barred them from appealling against 10 year equine keeping ban for first 5 years of that ban. If they did apppeal against sentence, it would be open to Crown court judge to increase sentence given (to maximum of 26 weeks, which is true 6 month sentence) and also to increase costs award to include costs incurred by prosecution in attending appeal against sentence.

JG already has £3k costs order from civil injunctive proceedings in high court re his failed attempt to have equines returned to him.

Even if JG has transferred ownership of farm to another, unless this was a transaction "at value" (ie sufficient amount of money changed hands) then this would be set aside and would still be treated as an asset. he will have been given a certain amount of time to pay after which time it can be enforced. If he declares himself bankrupt, again any transaction at undervalue would be set aside and the farm would be deemed to still belong to him.

hope this clears a few things up. shame prosecution didn't come a bit later on this year as law is about to change and maximum custodial sentence will be increased.

As for the trolls, lets hope they return under whatever bridge they came out from....
