Tell her to get her lorry, and go and get the horses.

Take another person with her - and also her cheque book.

Tell her to do it now.

Ditto this but personally I wouldn't take a cheque book, I'd take a camera and photograph the conditions & the horses, then let them try to get the money out of me. I'd also take someone to hold me back from smacking the person responsible in the face.

Call the Police first!!

I had to remove my horse from a livery yard at short notice because he was being neglected and the YO was trying to steal him.

If you call 0845 60 60 60 6 you will be routed to the nearest county force, so do it when you get near the yard. Inform them of the situation and that there could be a breach of the peace ie YO tries to prevent you removing your property. They probably won't be interested in the bill, as that's a civil matter. They should give you a reference number, and if you have any trouble, you call 999 and quote the number.

Good Luck!!

Gosh that sounds terrible, is there not anywhere near by (even if its just for a few days or a week) where the horses could be led to and stabled or turned out, say a local farmer field etc? then arrange transport in the next few days to move them back to where they are now supposed to be going.

Other than what everyone has suggested, I hope things work out.

Watch this space - thanks martlin! Will let you know outcome but looks hopeful we can get them out today.

You'd be daft not to - even in a situation like this. If it means the difference between removing your horses and not, I know which I would choose.

Well providing nothing goes wrong they should be moved later today. Phew! Thanks everyone for a super effort. God, I need a wine and chocolate now to combat stress.

So you should Martlin. Well done you! Let's hope it all gets sorted quickly for the poor woman and her horses.

Your poor friend! I know I'd be devastated to find my horses in such a state. I'm very pleased she thought to take a camera and I hope she gets her horses back safely. Please keep us updated

Just a lucky strike I think, I have been in a few sticky situations myself and have a habit of keeping even the weirdest of contacts just in case

Poor girl is now pooping her pants with fear at going to get them and cant get any moral support, other than Chris the driver.

Anyone fancy turning up on masse :-)

why dont she get the police on stand by
just ring and say about what has gone on and whats going to go on and the fact they maybe needed if need be they may just send someone out for back up anyway

the only danger with calling the Police....

if it seems likely to them that a breach of the peace may occur, they will remove those whose presence appears to be contributing - which would normally be the visiting person..

they are not there to make a judgement on the rights and wrongs of the situation

I disagree.

I suggested calling the police earler in the thread, specifically because I'd been in almost exactly the same situation myself.

I asked them to attend the yard with me, but they wouldn't as no criminal act had taken place. They would however come to prevent a breach of the peace. If the YO threatens or attempts to prevent the lady removing her horses, she is breaching the peace. Stealing horses (which is what the YO would effectively be doing) is a criminal act, not paying the bill because of breach of contract is a civil matter.

As long as she explains the situation, ideally has proof of ownership and conducts herself sensibly, the police should be supportive.

Tell your friend to go at a time when the yard is most busy with other liveries - that way you'll have witnesses should she kick off.

I'd definately remove the horses immediately as a matter of urgency and take lots of photos as well as video of the evidence. Try and get names of the people you spoke to regarding when they were last worked etc.

How come? I understand where you're coming from but I would have thought that, considering they'd never invoiced her and that surely the treatment of the animals means a break of contract, how could they expect her to pay? As she has the passports she can transport them so why would she have to take a cheque book? Not disbelieving you, but a genuine question

muffinino, i think she means that if it meant paying them for the livery, it would be better doing that than leaving without the horses. Basically, getting them out of there at any cost.
I would have been in a right state having to leave them another night there, what a shame. i think i would have just led them out and hoped that the nearest farmer would take pity on me weeping at their door with my sob story and lent me a field until i could get transport the next day.
Poor horses, i agree that iwouldn't have left it 2 months but hindsight is a great thing.
Can she not take someone large and intimidating with her. Tell her to get down the nearest gym, she would find someone big to go with her.
