URGENT advice needed please for a friend re removal of horses

Poor horses, i agree that iwouldn't have left it 2 months but hindsight is a great thing.
Can she not take someone large and intimidating with her. Tell her to get down the nearest gym, she would find someone big to go with her.

But I wouldn't be paying anything to someone who had my horses in that state; I'd take them and let them try to get the money from me, as surely by not caring for them/exercising them the yard have broken the contract? Which means that she can remove them without notice. They are the owner's horses so they can't stop her from taking them, surely?

ETA I thought that AmyMay might have knowledge of the specifics of the law or that has dealt with this before, so may know what cirumstances would lead to the YO being able to force the owner to pay before removing the horses. I thought that breach of contract means that the owner would be disputing the payment anyway and regardless, she would legally be able to remove her horses whatever the circumstances and it would be up to the YO to chase her for the money. I would be interested to now exactly what the law is.
 
not arguing with you about that, but if they block the entrances or whatever to stop them and it is the only way she can get them out, i think she meant as a last resort. What a horrible situation to be in. I meant to ask about the state of the other horses and their stables etc. If they are all poor then i would be calling the authorities, I forget what ILPH are called now.

I think the point is that getting the horses out of those conditions is the primary concern; the rights and wrongs and breaches of contract/ payment/ non-payment etc etc etc can all be sorted out later.

Amymay (I think?) was simply saying that in the event that you had to pay to get your horses out of that situation (if the YO were to block the OP from removing their horses citing payment of contract, which I think they are legally allowed to do in normal circumstances), then for goodness sake do it for the horses' sake and argue the fees later.

HELLOOOOOOO EVERYONE!
I am Cluedo's friend and the very distressed person that this terrible situation was about.
I have been told by Cluedo to give a update as many people are wanting to know whats going on.

I tell ya something i am soooooo greatful to you all for all your concerns and help its very much appreciated. THANKYOU!

Anyway i got my boys back THAT NIGHT however it did get a little messy and THE POLICE WERE CALLED.
It was a very stressful day i can tell ya, I drove 60 miles to pick my friend up for moral support and be on hand with the video recorder then had a further 70 miles to the place where my stallions was at.
I have to say i was sooooooooooo nervous i could not stop shaking ALL OVER and could hardly stand. We pulled into the yard and my friend shoved the headcoller and leadrope in my hand and said go and get ya stallions. Be strong and basically get some balls and take a deep breath and think of the state of the horses. I was shaking all over and said i couldn't seem to do it so the transporters girlf said ill come with you!
We went to go in the barn where they were kept and one of the owners (a man!) was stood right by the stallions door!
I just went apart again and said i couldn't bring myself to go in and get him and load him right in front of him so the gilf of the transporter said tell me what the horse looks like and ill go and get him for you as honestly guys i hate to sound a wimp but i was a mess.
I know that i shouldn't of been and should of been angry but i am not a confrointational person and i just couldnt bring myself to get it together as i knew it would not be straight forward.
Anyway i told the Gilf of the transporter it would be the first chestnut you come to and basically she went in there bold as brass and put the headcoller and leadrope on and walked him out. We all rushed him to get on the lorry and it was funny cause he is only a baby and has had much experiance in loading however he jumped on the lorry (perhaps because there was hay in there!!!!) he was sooooo thin, Hips, ribs, spine showing, muscle wastage, pee stains all over him and dried on him making him loose hair on his back legs. He stunk!
We just managed to close the doors on him when the owner (the man) came out and said "what are you doing". I said i was taking my horses. He said "have you piad the bill" and i went to discuss it with him and just got to "well this is the thing" and he said well you can f***ing get that horses back off the lorry and if you think you are taking the other one you you have another thing coming. He was shouting andd everything so my friend went into auto pilot and said we ARE taking them and if you think we would EVER take this horse off the lorry OVER MY DEAD BODY are they staying here another second.
My friend grabbed a headcoller and leadrope and went to go and get the other stallion and the man followed her shouting saying you can forget taking him and you dont know who your messing with and you are testing my patients. It all got heated and the owner had around (i believe) between 4-6 people stood in front of the other horses stable stopping my friend getting him.
My friend come stomping back grabbed the phone and called the police. The police were already aware we were going down there as i explained the situation and i got a incident number on hand. She called and after around 10 mins on the phone explaining whats going on and everything they sent a car out.
We waited by the horsebox for around 15mins before the police came. Every now and then the owner would come out and look at us stood by the box seeing what we were doing. It was wierd because i was a complete mess but held together by my friend and the superb help off the transporter and Gilf who were AMAZING and said we are getting these horses NO MATTER WHAT AFTER SEEING THE STATE OF one of the first horse.
Then whilst i was waiting for the police i spoke to my friend who appears as Cluedo and she had said she had been on here doing the forum and she had found out these people were WELL known to the RSPCA, ILPH and MANY people had had to do what i did.
Some people snatched their horses back, some people went in with their own force and some people called the policed but either way it had happened alot that people had sent their horses there and they had been neglected.
The stories i have heard since i can tell you are not nice about these people what they do with horses.

When the police arrived i spoke to them and the owner came out and stood next to me. The first thing the police said was "who's the owner of these horses and who has the passports?"
I said "i do" to the look of dissgust in the owners face as the day before i went there to get the passprts and paperwork that WAS MINE and that was the most crucial thing as without that i wouldnt have stood a chance. The police after i said they were mine and i had the passports turned round and said "you can go and get your other horse".

The police explianed to the owner they were my horses and settlement of the bill was now a cival matter but he would have to stand back and let me take the horses.
The owner i could tell had had this done before as he never muttered a word and just stood there. My friend went in the barn to get my other stallion and went into the first stallions empty stable with her camcorder to check the state of it and YET AGAIN it was disgusting had not been mucked out in looked like days, Flies everywhere, Pea all over the floor which he would of had to sleep in!
There was muck everywhere, it was sooooo hot in the barn, and guess what he had NO WATER AGAIN!!
His automatic water was not working and was not filling up so we had guessed he had been without water at least 28hrs as his automatic water was not working and was empty the day before when we got the passports. My friend went to the other stallion where there we lots of people standing by his door trying to stop us taking him and she walked straight through them.
She came out with him with his head on the floor, no energy, thin, dull coat, everything you can think and we loaded him with the police watching and the owner!

They were both glad to be on the horse box i can assure you.

We took some video footage of the hips and ribs sticking out on the lorry before telling the superb transporters to go and we will catch up but basically get out of here with the horses!

I spoke to the police who took some details and they even said thereselves they looked thin and not in good condition plus we were stood right in front of a paddock where there were two horses that were also so thin and we said look at them and they said "yes again thin".
They escorted us out to the car and that was that.

I had then 70 miles back to my friends place to drop her off and to drop off one of the stallions as he is staying with my friend as she has lots of grass, stallion paddocks and i think it will be like a little holiday after been cooked up in the stables 24/7.
After dropping one off at my friends i then had 60 miles back to staffs where the other stallion was coming back with me. We didnt get back to the yard until after 12.30pm and when i put the stallion in his stable with lots of bedding, haylage and fresh water he didnt know what to do first, Drink, Eat or lie down. He did after then get some flu symptons with a really runny nose and he was just dull and down but i have sorted him out so he is feeling better. He has since gone out in a nice big field with plenty of grass and a fly rug on where he is chilling and enjoying it. The first time i let him out he just galloped everywhere. He is going to be now brought in his stable in the day and out at night. He will be now on the recovering period where plenty of hay and feed will be given to give him the boost and get him looking and feeling like a stallion. Theres quite a long process but my friend says the stallion with her has already put weight on and has been wormed and is been fed up. He has settled down as for the first day or two he just never stopped galloping and pacing as he hadn't been out in months. He is now settled and getting used to the fact he is loved, Fed, and has grazing and fresh water and the ability to be a horse.

I must now give a warning to take into account the location of this place and sont go sending horses there. I cannot say where it is but its a well known centre. The appropriate people have been called everyone rest assure there.

Now thanks to everyone on here its appreciated. I neevr really go on forums but i will start doing as your like a BIG family.

Thanks to the transporter who was SIMPLY AMAZING and not enough praise could be given to him who is CHRIS ROSE transporter in Staffordshire and his Gilf. Please if anyone needs transporting give me a shout and ill give you his number as he is VERY resonable and is the biggest help EVER i simply could not of done it without them. When other transporters would not get involved he did and he also stayed involved while we were there. I have said i will throw alot of work his way now thanks to what hes done so if anyone needs transport give him a call as he id proberbly the cheapest you will find and is excellent!

Cluedo my friend who i have not known for years but is a wealth of knowledge and a brilliant friend who i have called upon many of times. She is the tyoe of friend you dont need to see or speak to everyday in fact we have only met once however she is a great friend and i owe her BIG TIME for all the help and advice she gives me. She must sit there on the phone thinking whats gone wrong now.
She says i should have a tag on and only be let out every now and again!

My friend Sonya who again i have known only a short amount of time but she has stepped right up to the plate and basically got my stallions back. Without her i would never of been able to do it i would have fell apart but she took complete control of the situation and was there for me which i cannot thatn her enough!

Sorry its a long update but rest assure guys they are in good hands now and are been spoilt again!
