Urgent advise needed!

To the all previous comments re- solisitor, sorry but i dont believe in them and never will.
I Have been experienced dealing with them in the past. All they want is ur money, they dont give a monkeys about ur case, emotions of ur financial situation. I have represented myself in court before and I won the case and had double of what ive been promised by them. They are bullies and if you are get a "cheek" to disagree with them they are turning really nasty.

Whatever , they can however tell what the law is and what you can and can't do without breaking it .
Your liverys comment about duty of care to you indicates she's not stupid and is well aware of her rights .

I would leave OP to it GS - she clearly knows what she is doing. Not sure why she has even bothered asking for advice on here...
 
OP - not sure if you've said whether they are stabled or living out, if it's the former and you have land to leave them out then I would do that to reduce costs . You have duty of care but that doesn't mean they have to be in. As their is no contract she can't complain.

The point is that spending an hour with a solicitor can ensure that you are propetly advised and can then go about things in the correct legal manner without breaking any laws yourself or getting yourself into more trouble/expense.

Hi I signed up to this forum to get advice and opinion from people who might be in the similar situation in the past, and if you read my pervious replies where I’ve explained that I haven’t got a huge experience in running LY you will understand why. I had a great support and help here.

Do a search of the Forum for past threads then, should be helpful. And you can't sell the horses without their passports, and also as their keeper, you legally have to be able to produce their passports within three hours if requested to by relevant agencies. You also have duty of care.

Also, you said you involved the police when the horse owner abused you via Facebook? Not sure why you haven't just requested a non-molestation order against her, as certainly the police would have advised this. Said order would prevent her or agents working for her from contacting you or entering your property. Therefore the horses would have to be moved.

This whole thing sounds very dodgy - was the person who originally arranged this "livery" even declaring it for tax purposes? Suggest you get that looked into as well. And if you won't go to a solicitor, or even join the BHS for their legal aid, then try your local CAB.

Everyone has done their best to help you, if you're just going to go it alone and ignore their advice to get legal assistance, then there really isn't anything else to add here. I for one am just going to ignore this thread now, as have said my piece.

As said, poor horses :(
 
If you have NFU insurance you can also get free legal advice from them.
I was told by the BHS last week that the gold membership is for individuals, and if you want legal business advice you should be a registered BHS instructor or a BHS approved yard, although I think some people have managed to get business advice on gold membership.
