Please join us in asking Judge Kainth to overturn his decision to return 29 donkeys and ponies to James Gray and to send 82 rescued horses to a public auction.

WHAT CAN YOU DO TO HELP?

Please write directly to Judge Kainth to express your views on exactly why these equines SHOULD NOT be returned to the Gray family and why the remaining horses SHOULD NOT be sent to a public auction.

Please ask every animal lover you know to write to Judge Kainth. There might only be a tiny chance that we can change his mind but for the sake of the horses that chance must be taken. BTW even if you are not living in the UK please write. If these animals are returned or sold then it will set a very bad precedent for future cruelty cases.

Thanks - yes, I think lots of us are planning on doing this.

I am mulling over what to say, as well as compiling info to include in the letter.

Are there any points in particular you advise including in the letter??
 
I quote the ILPH:

"We will be working closely with the RSPCA to do everything possible to get this decision reversed"

Unfortunately I'm not a legal expert so I can't give you a definate answer. The way I am looking at it is that if the ILPH and RSCPA and trying to get the decision reversed then there is a possibility that it may be. In which case the more public weight that is behind it the better.

AmyMay in my humble opinion you should write whatever you feel. You are entitled to your opinion and should give it in your own words. Mind you if I wrote what I was thinking it would be mainly full of four letter words.

I have had advice on this this morning. Judges are obliged to read correspondence pertaining to cases - even if sent from the general public.

There is usually a two week period in which time the judge receives reports and or correspondence and is obliged to take them in to consideration. Even if a decision has been made.

Also, as the Gray family are back in court on 28th April to determine their guilt on animal cruelty charges - it seems very, very premature for the DDJ to make any kind of judgement on the return of the 'pet's' and future of the other horses.
 
even if the RSPCA cannot overturn a criminal case decision surely they could launch a civil prosecution immediately which must enable a delay to the animals sale/return

after all the RSPCA has enough cash to do private prosecutions in regard to hunting and I'd have though 125 horses warrant more consideration when they are known to be at risk of harm.
 
I have to say that I am absolutely devastated at this decision, is it any wonder why the British Justice System dosent work, how on earth can this judge justify returning these poor animals to the nasty Gray family, they are not in danger my arse !!! of course they !!!!!! would a Judge send 3 children back to a family where the other 3 had been starved to death, I think not......

So now that the caring rescue centre's have rescused these lovely animals and put all their time and energy and resources into making them well again they are now to be sent to an auction which can be a terrifying experience for even the fittest animals let alone these poor pyscologically disturbed equines.

I despair of this world I really do, words fail me and my heart is breaking.
 
I have his email address at the law firm where he works. Im not sure whether it is ok to post it or not or even if it is any use so advice on that would be good.
 
hch - why not post the link to the company website...that way you're not publicising it (just in case!) but we could all find it....
 
Wouldn't want to be in this judges shoes, maybe he fears retaliation from the Grey family, they are nasty pieces of work by all accounts.
 
And remember that all letters must be written respectfully.... it is no good wielding a large amount of abuse at people.....

I think also it is important not to say that JG is guilty and throw accusations around, the trial has not yet been held and he is not proven guilty. My view on this is that no animals should leave the welfare organisations until after the trial when guilt is or not proven and that is what I have concentrated on in my letters.

PS I've just had the contents of the original post emailed to me by someone outside of the forum but who works in the industry so it's good to know that this is going viral in the horse communities. Let's just hope we can make a difference; writing a letter is a very small but important thing we can do to help these animals

Law: this was my letter: (I do have jetlag, so please be kind!) I have sent to the papers and radio stations (hence the longish introduction!)

Every single human being with a heart was affected after hearing that 111 horses were rescued from appalling conditions in January 2008.

With over 31 animals being found dead and decaying under the feet of those left strong enough to be standing it was a heart wrenching situation, which quickly turned to absolute anger that a human being could subject any living animal to such horrendous conditions.

A further three animals which were far too weak to be saved had to be put to sleep and the scene.

I cannot imagine the pain and suffering that these animals have been subjected too, having been starved and kept in the most appalling conditions where they were covered in excrement, mud and living alongside other dead animals. I believe one mare was completely blind, and there were also a number of foals on the farm, so the experience would have been even more terrifying for these poor animals. Those who rescued them said that they were petrified and just kept there heads down eating from the moment they arrived into safety.

The reason for my letter is that Deputy District Judge Sandeep Kainth has granted this family of animal killers the right to have 29 animals RETURNED to them as they were pets!

There is a huge community of people who have been totally destroyed by this decision after pulling together and helping these poor horses to live a much better life, one in which every animal, and indeed human being is deserving of.

To send these poor animals back to the same place where they were so horribly treated is a huge step backwards for all the caring charities and people involved in rescuing them. Is it not enough that these animals have been through so much already in their lives and deserve to be cared for without this happening again?

People who treat animals in such a way are usually punished with a ban blocking them from keeping animals in the future. All I ask is WHY in this case is such a horrible, horrible family allowed to receive back some of their animals after they have proved (On a HUGE scale) that they are completely incapable of looking after any equine animal.

Please could you highlight this judge’s decision and let’s hope that together we will be able to get it overturned before they return them to this family of killers.

Please also let me know if there is anything I can do to help. I know I am only a small voice, but I know of many people who agree with my opinions on this.

That is a defamatory statement. He has not been found guilty of anything.

Please take this letter off to preserve this post.
 
I have just written my letter, here is the body of the letter in case this helps anybody and is of any use. It went on one page.

Dear Judge Kainth,

I am appalled at your decision to return 29 donkeys and horses to Jamie Gray following their rescue by the RSPCA, especially in view of the fact that we await to hear whether he is guilty of cruelty or not. If it is proved that he was guilty of cruelty or neglect where would the logic be in returning these poor animals to his “care”. How can it be proved that these animals were his “pets”?

The decision to send 82 horses to public auction is laughable. The meat trade must be rubbing their hands in glee. Why can the charities caring for these equines not be responsible for homing these 82 horses with suitable owners? If the purpose is for Mr. Gray to be reimbursed for his 82 horses as quickly as possible then of course it is a very efficient way of dealing with the matter. I suppose you could say that at least these poor animals have had a few months of good food and kind care before they go back to what remains of their miserable lives.

I am fully aware of the fact that the law has recently been changed - and not before time - to allow more positive action where animals are perceived as being treated inhumanely. We must applaud that change in the law and what is represents - a more proactive approach by the Government to animal cruelty and neglect. I have no legal knowledge and have no idea how much discretion lies in the hands of a judge in a case such as this, or whether the action a judge takes has to be in line with guidelines prescribed by the Government. If discretion does exist, then I, and many thousands of people will be wondering why, in such a high profile case as this, a ruling wasn’t made that sent a clear message to the many thousands of dodgy dealers and meat traders - cruelty and neglect will not be tolerated.

Your ruling does indeed send a very clear message to the likes of Mr. Gray - “Do whatever you like”!

I am a responsible and caring horse owner and was involved in the rescue of these Amersham equines. Your ruling is a kick in the face of all who made enormous efforts to remove these horses and donkeys from unsuitable conditions and lack of proper care. Please reverse this decision.
 
The thing is, even if JG IS proven guilty at his trial, you can bet your Cavallo's that he's not going to get a prison sentence or a ban is he?

Otherwise why would the judge be allowing him the ponies and donkeys back?

i have written and sent my letter & i've send it to the prime minister (not that i like the guy or the things that he does) but maybe if we all email a copy of the letter to him as well as to the judge it might give us a bit more poke?
 
Just an idea - perhaps we could 'suggest' in our letters that DDJ S Kainth go and see for himself in person a couple of these animals for himself at one of the sanctuaries and look closely at the real suffering these poor animals have endured - up close and personal, rather than via photos, reports, witness statements etc etc

Just a suggestion as some people do not get any perception whatsoever on these type of neglect cases especially if the Judge is not 'horsey' and thinks they will bounce back into health/a good and fluffy home

IMHO I think he has not got a clue what has truly been put in front of him/or doesn't give a s**t - but that is only my opinion
 
Why oh why do we not have the same system as there is the US in which photos taken of the animals upon seizure are handed to the judge at the hearing and the said animals are then sometimes actually taken to the courts so the judge can see up close and personal how the animals have been turned around by their rescuers by simple TLC.
