Well, I don't think you can have the horse pts without the owners permission - unless of course some medical emergency has arrisen (broken leg, inoperable colic etc.) And of course the passport should be in your possession (but that's a whole other issue).

This person had an agreement (albeit verbal apparently) - and is now owed monies for unpaid livery. As the horse was being 'put up' or whatever you want to call it with the OP - she has a duty of care to ensure its welfare. She must still maintain its welfare, whether she gets paid or not, because the pony is in her care.

In order for the pony to be destroyed, I would imagine that some sort of legal advice would need to be sought - plus the agreement of a vet(s).

If she is not paid the unpaid livery, she may also take the owner of the pony to the small claims court.

Sorry to hear about your situation. I'd definitely stop referring to her as your friend as she clearly isn't. I know its now consolation but it shows you to be a much better person.

To be honest,this is just another sad example of how written contracts are necessary even with friends.

OP was paid to 'keep and eye on it'. The problem is what does this amount to. Does this mean full livery? If my pony was allowed to get into a state on full livery then I would be annoyed and the fault would lie with the YO. However I am paid £10 a week to feed a horse at my field 3 times a week and 'keep an eye on it'. This means that I call the owner if there is something wrong ie it is dropping condition/needs a vet/needs a rug etc.

On the other hand - if the owners refused to do something about the problem, I would feel MORALLY obliged to do something about it, whether or not legally it was my responsibility.

Anyhoo - enough of my ramblings......OP : I am sorry to hear of your recent troubles. Keep us updated on the situation. xx
 
The pony is getting as much hay as it can eat.....it doesnt have a rug on as,i dont have one to fit it.
What am i supposed to do on a day like today,when its blowing a gale and tipping it down with rain all my horses are in,and i have no room to bring it in......the best i can do is give it some hay under a hedge.
 
Are your horses in 24/7??

Could you not swap it around, so it could come in, in the day for a bit and get dry etc and eat some more??

To be honest, the only REALLY important thing here is the poor pony who should not be losing condition... Doesn't matter what she said, he said what about the pony?
 
I have to say I actually went to bed last night very worried about this pony. And feel just the same today.

If you feel the pony has now been abandoned, please contact the WHW to see what help they can given you. They may be able to offer it some respite care somewhere, in order for it to get dry and warm - and to get a rug on it, if nothing else at present. Until the issue with the owners is resolved.

Whats the cost of a cheap pony turnout anyway? £20?
I'm sure I have seen them for less as well. Not much in the grand scheme of things given the amount of hay being given.
The cost of the rug would be 4 bales of hay?!?!
None of us are "flush" at the moment, but that wouldnt stop me buying the poor mite a rug!
 
buy it a rug then demand the owner pays you back. She sounds like she would and its just your friend who's mucked you around. Its hard because its not technically your responsibility, however you cant turn a blind eye to the little pony if its suffering! what a horrible situation to be in

QR Sorry OP but if i was in your situation i couldnt stand back and watch the pony go downhill slowly.. if you cannot look after it, contact the ILPH or whatever they are called nowadays and let someone else take care of it.
Dont continue attempting to look after it if you cannot give it the full support/needs it needs.
 
Either take it on formally or take it back to them.

Sorry about your mum - lots of us have lost parents and it's a terrible thing, but you have to carry on and it is poo (and the crap friend is a not friend at all, but you have probably worked that out by now).
 
That will be fine, living out ponies are often out in the wind naked. Plenty of hay, fibre through the gut, that will help her keep warm. You've been dumped on, but you're doing your best.

So the other horses are in, dry and warm. The elderly pony is out, wet, cold and loosing condition. How is that doing one's best???

And once more for the people who don't understand welfare laws - this pony is the OP's responsibility as it is their care.

A wet pony would not normally be a concern, but this is a wet, cold elderly pony that from OP's admission, is going downhill. A bit of hay isnt going to cover it IMO, he/she needs rugging and a decent bit of feed inside to keep it going. While its on her land, it really is OP's responsibility to ensure that the pony recieves it.
 
Sympathy molehill - sounds like someone's just taken the mick and dumped it on you. Sounds like you need to bite the bullet abd borrow/buy a rug for the poor thing or find a welfare organisation to take it on and care for it. It's such a shame that so many old ponies end up as an unloved burden.

You should know by now that when the carpal tunnelers get your post it's going to just go downhill - so don't feel the need to defend yourself to them - you won't get any support or constructive discussion.

Anyway what kind of person has the time to make 13 posts a day (assuming they post every single day of the year) and rack up 25,000 posts. Makes you wonder if they even have horses - how on earth do they get the time?

The ones who "have racked up" the old post count generally tend to be the ones that have done the distance.....and are still here!
They are the people that always have full PM boxes as people tend to know that they will dispence the CORRECT advice, not whitewash over things to keep peace......in other words someone who cares passionately about the welfare of ANY equine!!!

But, some people like to think that it is, another requirement is that you've been a member for a year .. but you can't tar every "Carpal Tunneler" with the same brush..
 
What a terrible situation to be in. And you really do seem to have been put in the most difficult position. Hopefully, now that the actual owner of this pony knows the situation, it can be resolved quickly.

But in the meantime, it does sound as if it could be heading for trouble. I appreciate that you allready feel put out. And you are obviously out of pocket. The thing that concerns me though is your mention of the loss of condition. If a stable isn't available, then a rug would serve the purpose of more protection from the elements.

I do hope you manage to resolve the situation quickly. But in the meantime, as others have said, the duty of care lies with you.

Sounds like you have been treated really badly, but not as badly as they have treated this poor old pony. I have an oldie who i love dearly and can't bear the thought of a pony like him being out in the horrible weather we are having, without even a rug to keep him warm.
What size of rug does this wee lad need? He needs something, i am nearly in tears here thinking of him out in this when all the others are tucked up in their nice beds.
Please get him a cheap turnout for now or let us know what size he needs, perhaps one of us can help. What area are you in?
