Sold my horse and new owner is a nightmare

I would get him back and find a field to live in until your in a position to sell him. I don't think a charity would get involved a friend of mine had a livery leave a horse at her yard, she had to contact the police and put up abandonment notice then I think after a few weeks the person is entitled to sell on.

She’s never wanted me to take him back! She wants to keep him but wants her money back! Even when I offered to have him back when she was having issues she said she wouldn’t consider selling him.
Tell her you do not have any legal ownership of the horse.
It cannot now be returned by the purchaser (or YO). Horse was seen and tried, was not vetted despite it being suggested. Your offer to take back horse after a short while (.x time) was rejected by new owner so this is now something that the new owner must address.

End of.

In an ideal world, yes I'd collect horse and find somewhere, but your situation has now changed, hasnt it?
 
She has no right to send him back, but at the same time for the sake of the horse I personally would offer as much as I could to buy him back - be honest and tell her you've spent some of the money already and that also you're worried you'll need to spend time and effort potentially having to re-school the horse on its return. But no, of course she cant have a refund AND keep the horse, what world does she live in.

Just write her an email (paper trail) stating that of course she cannot have a refund AND keep the horse. Legally, thats not an option so why does she feel she has a right to ask. If the horse is not suitable for her, despite you being very honest about him then I would say you will pick him on a set date. If she keeps asking for a refund and to keep the horse I'd just get a solicitor to knock up a very quick letter stating it wont be happening.
 
She can’t drop him back to you or ask a charity to take him. The horse is her responsibility in light of owner’s seeming abandonment- and she needs to go through legal channels to have an abandonment notice served.

The only looser here is the horse. You really should have taken him back.


Oh come on, that last sentence is really unfair. New owner won't give the horse back, OP has nowhere to put the horse and in any case has posted that they can't afford to buy back at the price the new owner wants.

I agree that the horse is the loser, and that's pretty crap, but the OP has tried what they can to help and that's been turned down.

OP if you want the horse back, or think that you should, it can only come back to you through legal routes ie either being sold to you by the new owner or given/sold to you following YO going through the abandonment process. Otherwise there could be a mountain of trouble coming your way.

Can you put the people who were interested in the horse in touch with the YO, tho if the horse is now injured they might not be interested any more.
 
She doesn’t want to give him up! I’m also not in a position to pay that amount of money back? Both myself and OH are on reduced wages currently

But you said yo rang you to say his been abandoned by the owner so she obviously doesn't want him, I am not blaming you at all by the way you have done nothing wrong, the buyer sounds like a complete but job. But I couldn't just leave him there not knowing what will happen to him

it may be right for the horse but the horse isn't hers, the new owner is out of touch with their YO. There may be a genuine reason for that and if she turned up and found her horse missing OP would effectively have "stolen" him. He does not belong to OP, she cannot afford to pay for him and has nowhere to keep him and he is not for sale even if she could.

The YO does not own him and cannot pass him on or sell him ATM. This is a dispute between the YO and new owner. Hopefully there is a livery contract between them and a course of action for the YO. Hopefully also the YO will not take it out on the horse but will look after him.
Whilst it seems very possible the purchaser was dishonest, has now got tired of the horse and just walked away there is just the 1% chance she is unable to do anything for example in hospital. OK most people would have let someone know. I find it difficult that YO cannot contact her. Couldn't she just drive round and see her?

Well I’m a bit confused by that, I think the YO has been totally ignored and left in the dark. She’s definitely been there recently as she sent me a picture

That's fine for those of us who have our own land and can find a corner to put a horse in but OP sold this horse from livery, she has described her altered circumstances due to covid-19, which mean that she is not now in a position to pay livery for a horse that isn't hers. The horse is currently the YO's responsibility.

You don't have to do anything, you could block the owner and tell the YO as far as you're concerned the horse was sold as seen and you don't want her contacting you.

I just find it strange that you appear to feel nothing for the horse. It's not a welfare issue but far from an ideal situation for the horse to be in.
 
What a bloody nightmare. I must say I’ve been there as the buyer and my seller wouldn’t take the horse back. I had to a send to sales livery at my expense. The seller walked away and left it to me to sort out. The horse was purchased for 6k and I got all of my money back less the sales livery fee.

I have some questions before I can give advice as to what I would do;

How much was the sale for?
How old is the horse?
How long did you have the horse before selling?
Did you ride/compete regularly with the horse?
Why did you sell?
 
I am always suspicious about everything - have you checked out the yard Facebook page/website - is there any connection between YO and purchaser? The YO must know they can't just give you the horse back, he's not yours or theirs for that matter. It is very unfortunate that you have two people trying it on with you.

Absolutely this. You are no longer the legal owner of the horse. And nor is the YO. She has no right to drop the horse off with you even if you did agree to take him back. The new owner appears to have decided to walk away from her responsibilities and the YO appears to want an easy solutiuon but that's just tough. She now needs to serve an abandonment notice on the horse, allow the time to elapse when the owner could still reeapper and then once she legally owns the horse she couls approach you to see if you were willing to have the horse back under those circumstances. Or she could sell on herself as by then the owner will have lost any right to any of the sale price. Equally rthe owner could be ill or injured and utterly horrified when she resurfaces that her horse has been moved on without her permission or knowlege. Which is why there is a legal process that needs to be followed here. God what a mess!

I don’t know why you think I feel nothing for him? I’ve just tried to keep this post factual, I didn’t feel the need to pour all of my emotions into it, that’s a different matter that I have people to talk to about rather than telling strangers I still watch videos of me riding him and cry ??‍♀️
 
Op you have done your best. Please don’t get pressured into taking him back if you have no means to support him coming back. He was sold in good faith, unfortunately to someone who isn’t worth him. You cannot help that. Not everyone has money sitting to go buy back horses. I know I don’t.

I know everyone is thinking about the horse right now and yes you are right the best thing for him would be to go back to OP but it’s not an option. Very very sad situation. Hopefully the YO with her head screwed on can help the new Owner if not then the best thing for this horse would be to find a new home.

Yeah, I even found the post where the yard was recommend to the new owner. I don’t believe the YO is trying anything on but she does find the new owner a nightmare and wants her off the yard
