Company refusing to give a refund....advice please

It gets even better. EquiRubber seem to "not be in" to receive the letter before court action. They have also removed their address from their contact page on the website. Apparently they are now "part of " Arena Mirrors. I've sent an email with the letter attached. Clearly this will be going to court. Deep joy :(

try searching companies house online for an address for both companies, send to both referencing having sent it to the other in each letter so you have all bases covered.

What a saga well done for taking it further and not letting it lie. My concern for you at this point would be they dissolve “equirubber” and then essentially there’s no company anymore to fulfill your claim.

Screenshots from companies house- showing the old (dissolved) equirubber under Andrea’s name, and the new (current) one under Harrison’s name… he’s the sole director, so no one else you can really chase with this one- so yes, I’d be instructing the SCC as soon as possible and chasing him for the debt before he does a runner.

And yes- I’m posting information in the public domain so I can post names and addresses ?
Edited to add- his Facebook page does have both companies advertised on it though, so I’d assume that they’re still linked and have previously shut down and reopened in his name instead of hers ?

Mirrors for training aka Arena mirrors have a different address registered at companies house than those screenshots above. Same female owner though.

There are lots of equestrian companies doing this at the moment. Well known ones on companies house. My friend is owed money from one that runs live facebook auctions everyday they have a gazette notice against them. She put in a dispute and is waiting for her money. And still the live auctions carry on.

Andrea was straightforward and good to deal with when Mirrors for Training supplied and installed 4 mirrors here 10 years ago. They are still up, and have lasted well in a very windy area. She stood by her product when I had some issues, and it all got sorted at no extra cost to me.

Having said that, I've not had need to have any dealings with her for 9 years.

Lucky you Tiddlypom. Unfortunately for me Andrea messaged today to inform me they had taken over EquiRubber from the 1st February. Orders and refunds prior to that are nothing to do with them. Her son has ceased trading. When I asked for his receiver/administrator details she said she didn't know them and blocked me from being able to message her.

Oh heck, that's terrible :oops:. I didn't realise that he was her son. I fervently hope that you get all your money back.

How do such people sleep at night. She's not a greenhorn.

Andrea, if you are reading this, you should be utterly ashamed of yourself. If anyone asks me who installed my arena mirrors, and plenty have, I shall tell them to avoid Mirrors for Training like the plague.

I'm not an insolvency specialist, but if the company is still trading, even with new owners, it is still liable for its debts. There's usually a contract between the previous and current owners to agree who ultimately bears the cost of any liabilities, but that's nothing to do with the company's creditors. So unless the company has been placed in liquidation and she has taken over the business but not the actual company, you should still be able to go after them.

And if it is in liquidation you can put a claim in to the liquidators, but I wouldn't hold out much hope of getting anything back. The preferential creditors like HMRC usually get most of the cash unfortunately.

It was far easier than going to court and possibly not getting any money back at all. The mirrors arrived first thing this morning and are lovely.

Sounds like son has got himself in over his head and it's all come crashing down, so mum has jumped in to do the motherly thing and save the day by taking on his business and running it will - as it sounds like the arena mirrors is a reliable company.
Not saying that protecting her son is the right thing to do, but lots of mums would do the same thing.
I'm glad you could come to some sort of resolution OP but I'm sorry you had to go through this in the first place!

Glad you got things sorted jules9203. We have also been in contact with Andrea who also offered us mirrors but we pushed for the rubber instead. She has assured us that it will arrive with their new haulage company on Tuesday, I really hope it does this time....5th time lucky!

That sounds like a pretty good and honourable outcome to me. There was no legal obligation for her to take on the debit of a failed company. I'm glad you are settled about it.
