Hi I'm new and I have a bit of a problem, I was wondering if anyone could help.
So basically I agreed to swap horses with a good friend of mine, she wanted my perfect little pony who I'd sadly outgrown for her daughter and I needed a nice, safe, steady horse to get my confidence back on. She gave me a sweet 16.2hh, 12 year old, friesian cross who she said was really nice to ride, easy to handle, ect.
The mare she's given me has been a broodmare for the past 5 years and was occasionally ridden in that time, so I rode her before we did the swap and I wasn't that comfortable on her but because I wanted everyone else to be happy I went along with it as always. I did tell people that I wasn't too comfortable with her but they said 'Oh don't worry you'll get used to her' but now she's just horrible and not what my friend said at all. She is pushy, has no breaks and tries to take off with me, today she kicked me because I wouldn't let her out of the stable.
The deal was that if either horse turned out to be not as the owner said then we would just swap back but my mum doesn't want my pony back because the woman has just ruined her, she's gone lame but apparently still able to be ridden, she's in a field with a gelding who is constantly beating her up and then I went to go and take her for a goodbye hack a few days ago and she went crazy. We haven't managed to swap passports yet so legally I don't own the broodmare and she doesn't own the pony.
I've talked to another friend and she said that I could give the broodmare back and get the cost of the pony but I doubt that's true. So can anyone give me any idea of what I can do or where I stand legally?
